Terms of Service
Terms governing your use of SmartGate — accounts, API keys, billing via Paddle, acceptable use, MCP tool access, data handling, and support contact for smartgate.network.

These Terms of Service ("Terms") govern access to SmartGate at smartgate.network and related services. By creating an account or using the service, you agree to these Terms.

1. The service
SmartGate is an MCP-native algorithm gateway. It provides tool endpoints (such as fetch, search, compression, deduplication, budget guard, memory, and pipeline tools) for AI agents and developers. SmartGate is not a general-purpose LLM proxy or chat API — you continue to use your own model provider.
We may update features over time. Material changes to these Terms are described in Section 14.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. If you use SmartGate on behalf of an organization, you represent that you have authority to bind that organization.
3. Accounts and API keys
- You are responsible for maintaining the confidentiality of your account credentials and API keys.
- You are responsible for all activity under your account and keys, including actions by agents or integrations you configure.
- Do not share API keys in public repositories, client-side code, or unsecured channels.
- Notify us promptly at support@smartgate.network if you suspect unauthorized use.
We store only a hashed form of API keys, not the raw secret.
4. Acceptable use
You agree not to:
- Violate applicable laws or third-party rights.
- Use SmartGate to attack, probe, or disrupt our or others' systems.
- Circumvent usage limits, billing controls, or access restrictions.
- Use the service to process content you do not have the right to access or disclose.
- Resell or sublicense the service except as expressly permitted in writing (e.g., Enterprise agreements).
We may suspend or terminate access for violations.
5. Subscriptions and billing (Paddle)
Paid plans are processed by Paddle.com Market Ltd ("Paddle"), which acts as Merchant of Record for checkout, tax calculation, invoicing, and payment collection where applicable.
- By subscribing, you also agree to Paddle's Terms and Paddle's Privacy Policy.
- Prices and plan features are shown on our Pricing page and in Dashboard → Settings → Billing.
- Subscriptions renew automatically unless cancelled through the billing portal or as described in the Dashboard.
- Refunds and chargebacks are handled according to Paddle policies and applicable law. Contact us or use the billing portal for subscription changes.
SmartGate provides the software service; Paddle handles payment processing as MoR.
6. Plans and usage limits
Usage limits depend on your team's plan. Current public limits include:

We may enforce rate limits and fair-use policies. Exceeding limits may result in throttling or required upgrade. Enterprise overrides may apply by contract.
The Free plan includes full MCP tool access subject to monthly token and playground caps described in the Dashboard.
7. Service availability
SmartGate is provided on an "as is" and "as available" basis. We aim for high availability but do not guarantee uninterrupted service. Maintenance, third-party outages, or force majeure may affect access.
8. Intellectual property
We retain all rights in SmartGate, its documentation, branding, and underlying technology. These Terms do not grant you ownership of our IP. You retain ownership of content you submit, subject to the license below.
You grant us a limited license to host, process, and display your content as needed to operate the service (including audit and analytics described in our Privacy Policy).
9. Third-party content and URLs
Tools such as smart_fetch may retrieve content from URLs you or your agents supply. You are responsible for ensuring you have permission to access and process that content and for complying with third-party terms.
10. Termination
You may stop using SmartGate at any time and cancel paid subscriptions via the billing portal. We may suspend or terminate accounts that violate these Terms or pose security or legal risk. Upon termination, your right to use the service ends; certain sections (e.g., liability, indemnity) survive.
11. Disclaimer of warranties
To the maximum extent permitted by law, SmartGate is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, SmartGate and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our aggregate liability for claims relating to the service shall not exceed the greater of (a) amounts you paid us in the twelve (12) months before the claim or (b) USD $100.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
13. Indemnification
You will indemnify and hold harmless SmartGate from claims arising out of your use of SmartGate, your content, your violation of these Terms, or your violation of third-party rights.
14. Governing law and disputes
The parties will attempt to resolve disputes in good faith before pursuing formal remedies. Any formal proceedings are subject to applicable mandatory law and the courts of competent jurisdiction. Nothing in these Terms limits mandatory consumer rights in your jurisdiction.
15. Changes
We may update these Terms. We will post the revised Terms with a new effective date and, for material changes, provide notice via email or the Dashboard when practicable. Continued use after the effective date constitutes acceptance.
